Terms of Service
By using the PulseFresh platform and hardware, you agree to the following terms. Our goal is not to complicate legal texts, but to clearly express the boundaries, your rights, and our responsibilities in a plain, human language.
1. Scope and Structure of Service
PulseFresh provides hardware sensors (IoT) and a cloud-based software (SaaS) infrastructure. The system collects, encrypts, analyzes, and reports industrial cold chain data.
- Hardware (SenseTag, CoreHub, etc.) can be leased or purchased. Purchased hardware requires an active SaaS subscription to process data.
- AI analytics and shelf-life predictions provided through the platform are decision-support tools offered to streamline your operations.
2. Customer and User Responsibilities
For the system to function correctly and healthily, you have some basic responsibilities:
- You must use the hardware according to the User Manual, without exposing it to physical damage or liquid (outside IP certification limits).
- You are fully responsible for the security of your passwords and API keys provided for dashboard access.
- Intentionally reverse engineering the platform or attempting to find system vulnerabilities is considered a breach of contract.
3. Intellectual Property Rights
All software codes, AI algorithms, interface designs, and trademarks within the PulseFresh infrastructure belong to our company (PulseFresh Inc.).
- Purchasing the service does not mean you buy the source code or ownership of the algorithms; you are only granted a usage license.
- However, the operational data generated by your hardware (temperature records, logs) belongs entirely to you. You can export or delete this data at any time.
4. System Uptime (SLA) and Maintenance
Uninterrupted operation is our primary priority.
- We target a 99.99% monthly uptime for our servers.
- We perform scheduled system maintenance and updates during low operational traffic hours and notify you at least 48 hours in advance.
- PulseFresh cannot be held responsible for data delays caused by signal jammers, telecommunication (GSM) infrastructure failures, or force majeure events.
5. Limitation of Liability
PulseFresh is committed to providing you with the most accurate and real-time data. However, ultimate operational decisions and cargo security lie in your initiative.
- When the system issues a danger alert (alarm), you are obliged to take the necessary physical intervention.
- PulseFresh cannot be held directly liable for product spoilage due to temperature breaches, physical cargo damage, or commercial compensations paid to third parties.
6. Pricing and Payment Terms
The PulseFresh SaaS platform operates on a subscription model.
- Subscription payments are collected in advance at intervals specified in the contract (monthly or annually).
- In case of a 15-day delay in invoice payment, data transfer from hardware may be suspended.
- If pricing for the next period changes, you will be notified at least 30 days before your current subscription period ends.
7. Termination and Cancellation
Both parties have the right to terminate the service agreement under certain conditions:
- You can cancel your subscription without penalty by giving written notice 30 days before your renewal period.
- Upon cancellation, once your data is delivered to you in accordance with GDPR/CCPA processes, it is completely deleted from our servers (unless legally required to be kept).
- Leased hardware must be returned to us in full and working condition at the end of the contract.
